1 What this statute requires
18 U.S.C. §2257 (and §2257A, for simulated conduct) requires anyone who actually produces a visual depiction of a real person engaged in actual sexually explicit conduct to verify each depicted performer's age and identity, keep those records, and post a statement identifying where the records are kept and who the custodian is. The statute's own definition of "produces" is broad — it reaches a primary producer (who films or photographs the conduct) and, in some cases, a secondary producer (who duplicates, reproduces, reissues, or otherwise inserts a copy of that depiction into a computer service).
A site only owes these obligations if it actually falls into one of those two categories. Section 2 explains why Salacious, as built, doesn't.
2 Why this site is exempt
Salacious is a bookmark-management and link-sharing tool. An account can save a link to a page elsewhere on the internet, optionally tag it, and optionally make it public for other accounts to browse. For a small set of supported video platforms, Salacious can show that platform's own embedded player directly on a bookmark's page, the same way embedding a YouTube video on any other website works.
At no point does Salacious itself film, photograph, duplicate, re-host, or reproduce a copy of any visual depiction. It stores a link and, for its own preview purposes, whatever metadata (a title, description, thumbnail) the linked page already publishes about itself — never a copy of the underlying video or image file. That means Salacious does not meet the statutory definition of a primary or secondary producer under 18 U.S.C. §2257(h), and this statement is accordingly an exemption statement: there is no records-custodian information to post here, because there are no 2257 records for this site to keep.
3 Third-party & embedded video
Where Salacious shows an embedded player for a supported video platform, that content is hosted, produced, moderated, and made available entirely by that third-party platform. Any §2257/2257A compliance applicable to it is that platform's own responsibility, not Salacious's — the same way a news site embedding a YouTube video isn't responsible for YouTube's own content policies.
4 User-submitted links
Accounts are responsible for what they choose to bookmark and, if they choose to, make public — see the Terms of Service. Salacious does not review, host, or copy a destination page's content before a link can be saved; saving or publicly sharing a link doesn't make Salacious the producer of whatever is at that link.
5 Advertising content
This deployment may show advertising from third-party ad networks in designated placements. Ad creative shown this way is supplied and controlled by the ad network and its advertisers, not by Salacious's operator — compliance for any adult-oriented ad creative is the network's and advertiser's responsibility.
6 Reporting a concern
If you believe a specific link, bookmark, or embed available through Salacious involves a minor, or otherwise violates the law, contact us immediately at [email protected] with the specific bookmark URL. For content that may involve child sexual abuse material, please also report it directly to the National Center for Missing & Exploited Children at CyberTipline.org and, where appropriate, local law enforcement. We will remove or disable access to reported content from within Salacious while we look into a report, and will cooperate with legitimate investigations.
